Can I file bankruptcy with my girlfriend or boyfriend?

No. Only married couples can file bankruptcy jointly. However, if you have any joint credit cards, accounts, mortgage or co-signed any other debt obligation, the creditor can go after your girlfriend or boyfriend when either of you files for bankruptcy. The debt will have to be listed and you will have to list your girlfriend or boyfriend as the co-debtor. They will receive a notice in the mail that you are filing bankruptcy. If the debt is discharged in the bankruptcy, they will then be fully responsible for paying off the entire debt.

While you cannot file jointly, you can file separately and have your case administered together. Generally, filing a joint bankruptcy petition does not have any advantages. If only one person files, only that person’s credit rating will be affected, making it easier to obtain credit in the future if the person who does not file for bankruptcy can maintain good credit.
